承包商在接到業主未明確承諾對于中標通知書之前完成的業主指定工作給予合理的報酬的意向書后，應主動向業主寫信。例如
Dear Sir or Madam:
Re: Employer’s intention to enter into a contract with us for Good Luck Plaza
Thank you for your letter of 7 May 1999 informing us of the Employer’s intention to enter into a contract with us for this project on the basis of our tender of 5 January 1999. You request us to start the access to the site in anticipation of the contract. However, before undertaking this preparatory work we would like to have an express undertaking from the Employer to reimburse the cost of any work so undertaken, together with a reasonable allowance for overhead and profit, should the contract not proceed for any reason.
On receipt of this undertaking, we shall proceed immediately in accordance with your request.

3. 協議書
協議書是專門用來使合同文件正規化的書面文件。根據法律規定，協議書不是為形成合同文件所必需的。但是，在大型工程項目施工合同中，簽定協議書是一種慣例。協議書實際上是合同文件的濃縮。它列出合同各組成部分的名稱，簡略敘述合同的重要內容，如工程內容、完工時間、誤期賠償及付款辦法等；同時，也可以包括某些類似于合同條款補充和擴展的條文。
